STATE OF NEW HAMPSHIRE
In the Year of Our Lord One Thousand Nine Hundred and Ninety-Nine
AN ADDRESS for the removal of David A. Brock, chief justice of the New Hampshire supreme court, from his said office.
Be it Enacted by the Senate and House of Representatives in General Court convened:
The house of representatives and senate in general court convened, satisfied that the public good requires that the cause for removal is stated fully and substantially, that there is reasonable cause for removal, that the grounds for removal are not sufficient grounds for impeachment, and that the public good requires that David A. Brock, chief justice of the New Hampshire supreme court, should no longer hold and retain said office, respectfully address and request your excellency, with the advice and consent of the council, to remove said chief justice David A. Brock from his said office. Said causes for removal are stated substantially as follows:
1. Chief justice Brock's tenure has resulted in the destruction of the court's mantle of impartiality by suppressing the right of free speech through the creation of administrative rules which encourage a policy of silencing and punishing the court's critics.
2. Chief justice Brock has attempted to conceal records of judicial misbehavior and complaints from the legislature and the people.
3. Under chief justice Brock's leadership, the court has engaged in usurpation of legislative and executive authority.
4. Chief justice Brock has engaged in attempts to intimidate a legislator who proposed judicial reform which was repugnant to the self-interest of the court; and
5. Under chief justice Brock's leadership, the court has embarked on a campaign of pro-active behavior in the realm of policy.
